Internet sans Frontière and Association 1901 Law whose goal is the promotion and defense of freedom of expression, firmly condemn the lawsuit brought against the blogger for rumors about the President and his wife and asks specifically that the complaint's motive be requalified.
It is unacceptable for a news outlet to attack a blogger under an accusation of introduction of fraudulent data in a electronic system.
While the judge may want to evaluate whether the information published by the blogger warrants a claim for violation of privacy, a lawsuit for another cause of action is shocking.
As a reminder, introduction of fraudulent data in an electronic system is an offense of extreme gravity, as provided in Article 323-3 of the Penal Code which states: "The act of fraudulently introducing data in an automated system or of suppressing or fraudulently modifying the data which it contains is punishable by 5 years of jailing and a fine of 75,000 Euros."
The post at issue on the blog housed on the JDD's ( Online version of Journal Du Dimanche ) servers cannot be targeted by this criminal procedure and can only be the object of a civil action.
There is in the initiation of this procedure an obvious will to equate the blogger to an electronic pirate, which we vehemently denounce.
